Transmission creating .part files for non-selected downloads

Transmission, has created .part files and downloading a portion of the files even though they have been unchecked in the "Files" tab,so as to not download them. Seems like it's been happening for a while I dont know what version since but at least since the 2.30s and even on a current version 2.40b3.

I have screenshots but I'm at work so I may be able to post them. This has happened a Debian install and an Ubuntu install. Let me know of further details needed.
